Court backs Bush on Islamic wiretapping appeal

San Francisco - A federal appeals court rejected a lawsuit on Friday that challenged the government's wiretapping of an Islamic charity without a warrant. In a 3-0 decision, the US 9th Circuit Court of Appeals in San Francisco sided with the government, saying that allowing the lawsuit to proceed would threaten national security.

"We acknowledge the need to defer to the executive on matters of foreign and national security and surely cannot legitimately find ourselves second-guessing the executive in this arena," Judge M Margaret McKeown wrote on behalf of the three-judge panel.
